DP to EP and DP to LOC conversion routes: Common mistakes and rejection reasons

Converting a Dependant’s Pass to an Employment Pass, or securing a Letter of Consent so a DP holder can work for a Singapore employer, trips up more applicants than almost any other pass transaction. This guide sets out the common mistakes we see at Little Big Red Dot’s sister agency, and how to avoid rejection.

This article is general information, not immigration or legal advice. Where a case has unusual facts, we work with a panel of employment law advisers to check the position before anything is submitted.

What DP to EP and DP to LOC conversion actually means

A Dependant’s Pass (DP) is issued to the spouse or children of an Employment Pass, S Pass or Personalised Employment Pass holder, and by itself does not carry a right to work. There are two separate routes into employment: converting the DP holder’s status by applying for their own Employment Pass in the same way as any other candidate, or applying for a Letter of Consent (LOC) that lets the DP holder take up work while remaining on the Dependant’s Pass. These are not the same product, and mixing them up is the single most common cause of delay in this space.

Who this route is for

This applies to DP holders who already have a firm job offer in Singapore, and to the employers sponsoring them. It covers a spouse moving from unpaid dependant status into salaried employment, a DP holder starting or co-owning a business, and cases where the family’s primary pass holder changes employer or pass type midway through the DP holder’s own application.

Eligibility requirements

For the EP conversion route, the DP holder is assessed exactly as a fresh Employment Pass candidate would be: against the qualifying salary threshold, which is assessed on the COMPASS framework points system, and against the employer’s ability to demonstrate a genuine business need for the role. The DP itself confers no priority or fast track. For the LOC route, eligibility depends on whether the DP was issued by the Ministry of Manpower (MOM) or by the Immigration and Checkpoints Authority (ICA), since the two agencies each administer a distinct Letter of Consent product for dependants under the work pass framework set out in the Employment of Foreign Manpower Act.

Cost and timeline

Employment Pass applications processed through MOM’s online system typically take up to three weeks from submission, though manual review can extend this to eight weeks or longer where documentation is incomplete. The Employment Pass application fee is S$105, with a further S$225 issuance fee once approved. Letter of Consent applications are generally faster, often clearing within one to three weeks, and do not carry the same government application fee structure as a full Employment Pass, though employers should budget professional fees separately if using an agency. Renewal cycles for both routes typically run one to two years, aligned to the underlying pass validity.

Employers should also budget for the practical costs around a conversion: medical checks where required, updated employment contracts reflecting the new pass basis, and, where the family’s other passes need reissuing, the associated Dependant’s Pass fees for children or a non-working spouse. None of these figures are waived because the candidate is already in Singapore on a Dependant’s Pass; MOM treats the underlying application on its own merits.

Step-by-step: DP to EP conversion

  1. Confirm the job offer and salary meet the current qualifying threshold under the COMPASS points framework before applying.
  2. The sponsoring employer submits the Employment Pass application through MOM’s online portal, naming the DP holder as the candidate.
  3. Once the new Employment Pass is approved, the DP holder surrenders the existing Dependant’s Pass, since a person cannot hold both simultaneously.
  4. The DP holder collects the new Employment Pass card and updates their address and employer records accordingly.

Step-by-step: DP to LOC route

  1. Identify whether the Dependant’s Pass was issued by MOM or by ICA, since this determines which Letter of Consent product applies.
  2. The employer submits the LOC application referencing the existing valid Dependant’s Pass.
  3. Once approved, the DP holder may commence work for that specific employer only, for as long as both the underlying DP and the LOC remain valid.
  4. Any change of employer requires a fresh LOC application; the approval is employer-specific, not a general work authorisation.

Common mistakes and rejection reasons

The most frequent error is assuming a Letter of Consent automatically upgrades to permanent work rights; it does not, and lapses the moment the underlying Dependant’s Pass expires or is cancelled. A second common mistake is applying for an LOC when the family’s sponsoring pass holder is between employers, since a gap in the primary pass invalidates the dependant’s status entirely. Employers also frequently under-document the genuine business need for an EP conversion, treating it as a formality because the candidate is already resident in Singapore; MOM assesses the role on its merits regardless of the applicant’s existing pass. Finally, some applicants submit an EP application while a LOC is still active, without first checking whether the DP needs to be surrendered at the right point in the sequence, which can create a processing conflict between the two pending applications.

A further mistake worth flagging: some families assume that once one DP holder’s LOC or EP conversion is approved, the same treatment automatically extends to other dependants in the household. Each Dependant’s Pass holder is assessed individually, and a spouse’s approved LOC has no bearing on, for example, an adult child on a separate Dependant’s Pass who wishes to work; that would typically require its own work pass route entirely, such as an S Pass or Work Permit depending on the role and salary. Employers sponsoring the conversion should also keep in mind that MOM periodically reviews the fair consideration obligations attached to Employment Pass applications, so a DP-to-EP conversion for a role that could reasonably be filled locally may draw more scrutiny than a straightforward LOC for part-time or flexible work.

FAQs

Can a Dependant’s Pass holder start working before the Letter of Consent is approved?
No. Working before approval breaches the conditions of the Dependant’s Pass and can jeopardise both the LOC application and the family’s existing passes.

Does converting from DP to EP affect the rest of the family’s passes?
It can. Once the DP holder becomes the Employment Pass holder in their own right, other family members may need their own Dependant’s Passes reissued against the new pass.

Is the Letter of Consent tied to a single employer?
Yes, generally. A new LOC application is needed if the DP holder changes employer, even where the underlying Dependant’s Pass stays the same.

Can an EP conversion be appealed if rejected?
Applicants may request reconsideration through MOM’s usual appeal channel, though a fresh application with stronger salary or role justification is often more effective than an appeal.

What happens to the Letter of Consent if the family’s main pass holder is retrenched?
The LOC and the underlying Dependant’s Pass both depend on the primary pass holder’s status. If that pass lapses or is cancelled, the dependant’s work authorisation generally lapses with it, and the family should plan for this before it happens rather than after.
