Introduction to Fair Employment Practices

To promote fair employment practices and enhance labor market transparency, employers submitting Employment Pass (EP) applications must first advertise the job on MyCareersFuture and give fair consideration to all candidates.

Fair Consideration Framework (FCF)

The Fair Consideration Framework (FCF) outlines the requirements for all employers in Singapore to ensure fair consideration of candidates for job opportunities. Employers must not discriminate based on non-job-related characteristics such as age, gender, nationality, or race. Adherence to the Tripartite Guidelines on Fair Employment Practices is expected from all employers in Singapore.

Advertising Requirements

Accuracy of Advertisements

Job advertisements must clearly state the job requirements and salary to attract suitable candidates. EP applications linked to discriminatory or inaccurate advertisements will be rejected:

– Advertisements must not contain discriminatory words or phrases.
– The job advertised must match the occupation in the EP application.
– The employer submitting the EP application must be the same as the one in the job advertisement.
– The salary offered must be clear, specific, and consistent. The advertised salary range:
– Must be visible to all candidates and cannot be hidden.
– Cannot be too broad; the maximum salary cannot exceed twice the minimum salary. For example, if the minimum salary is $4,500, the maximum salary should not exceed $9,000.
– Must include the salary offered to the EP candidate.
– If an advertisement is used for multiple EP applications, the total number of EP applications cannot exceed the number of vacancies advertised.

Duration of Advertisements

Job advertisements on MyCareersFuture must be open for at least 14 consecutive days to allow job seekers to view and apply. This applies even if you repost an advertisement that has closed.

If any advertisement details such as job title, salary, or number of vacancies are changed, a new advertisement must be posted and kept open for another 14 consecutive days before submitting the EP application. This ensures job seekers are aware of updated job details and have an opportunity to apply.

Advertisements that have expired or been closed for more than 3 months cannot be used for EP applications. The vacancy must be re-advertised to reach new job seekers.

Exemptions from Advertising Requirements

All employers must practice fair hiring, even if their job vacancies are exempt from advertising on MyCareersFuture. Exemptions apply if:

– Your company has fewer than 10 employees.
– The fixed monthly salary for the vacancy is $22,500 or above.
– The role is short-term (not more than 1 month).
– The role is to be filled by a local transferee.
– The role is to be filled by an overseas intra-corporate transferee.

Example of Exemption

If the position is being filled by an existing employee transferring to another related branch, subsidiary, or affiliate in Singapore, you are exempted from advertising requirements.

By adhering to these guidelines, employers can ensure fair employment practices and contribute to a transparent and equitable labor market in Singapore.
