Can Work Permit and S Pass Holders Rent an HDB Flat? The Rules for Landlords and Tenants

Blocks of HDB public housing flats in Singapore at sunset under a cloudy sky

Short answer: Yes, in most cases. Employment Pass and S Pass holders can rent an HDB flat, as can Malaysian Work Permit holders and non-Malaysian Work Permit holders in the services sector. The owner must be a Singapore Citizen past the Minimum Occupation Period, and renting a whole flat to a non-Malaysian non-citizen is subject to HDB’s Non-Citizen Quota.

Key facts at a glance

  • Only Singapore Citizen owners who have met the Minimum Occupation Period (usually 5 years) may rent out an HDB flat; Singapore PR owners may not (HDB, as opened 7 November 2026).
  • Non-Citizen Quota: 8% at neighbourhood level and 11% at block level, applied when any tenant of the whole flat is a non-Malaysian non-citizen. It does not apply to renting out bedrooms (HDB).
  • Eligible employee passes per MOM: Employment Pass, EntrePass, Personalised Employment Pass, S Pass, and Work Permit holders who are Malaysian or work in the services sector (MOM page last updated 2 June 2026).
  • HDB asks that the tenant’s pass has at least 6 months of validity at the date of application, and that tourists are not tenants.
  • Whole-flat occupant caps: 4 for 1-room and 2-room, 6 for 3-room and bigger, temporarily 8 for 4-room and bigger until 31 December 2028 (MOM and HDB).
  • The employer must declare the worker’s address in OFWAS before Work Permit issuance and update any change within 5 days (MOM).

Can work permit and S Pass holders rent an HDB flat?

Yes, subject to pass type, sector and the flat’s Non-Citizen Quota status. HDB lets non-citizens who are legally residing in Singapore rent a flat if they hold an Employment Pass, S Pass, Work Permit, Student Pass, Dependant Pass or Long-Term Social Visit Pass.

MOM’s housing page for employers (as updated on 2 June 2026) lists the foreign employees allowed to rent HDB flats: Employment Pass holders, EntrePass holders, Personalised Employment Pass holders, S Pass holders, and Work Permit holders who are either Malaysian or work in the services sector. MOM adds that non-Malaysian Work Permit holders from the manufacturing sector may rent bedrooms but not the whole flat.

HDB’s own eligibility page states that Work Permit holders from the construction, manufacturing, marine and process sectors must be Malaysian, and that tourists are not allowed as tenants. The two pages are worded differently, so a non-Malaysian Work Permit holder outside the services sector should check the position with HDB and MOM before signing anything.

Which pass types can rent an HDB flat?

The table below combines the MOM and HDB pages. Check the current pages before you commit, because the rules are updated from time to time.

Dependant Pass and Long-Term Social Visit Pass holders are also on HDB’s list of permitted tenants. If you are bringing family, see our guide to Dependant’s Pass and LTVP in Singapore.

What is the Non-Citizen Quota for renting an HDB flat?

The Non-Citizen Quota is a cap on how many flats in an area can be rented to non-Malaysian non-citizens. HDB sets it at 8% at neighbourhood level and 11% at block level.

HDB says the quota helps maintain a good ethnic mix in HDB estates. It applies when any tenant renting the whole flat is a non-Malaysian non-citizen, which includes Singapore Permanent Residents as well as foreigners. Malaysians are not subject to it. Once the quota is reached in a neighbourhood or block, only Singaporeans and Malaysians can rent a flat there. HDB states that the quota does not apply to the rental of bedrooms.

Owners can use HDB’s e-Service to check whether a particular flat can be rented to non-Malaysian non-citizens. A prospective tenant or employer should ask the owner to run this check before the tenancy is agreed.

Who can rent out an HDB flat to a foreign worker?

Only a Singapore Citizen owner who has fulfilled the Minimum Occupation Period (MOP) can rent out a whole HDB flat. HDB states that Singapore Permanent Resident owners are not allowed to do so.

The MOP is generally 5 years. HDB states it is 3 years for a non-subsidised flat bought from the open market, without a housing grant, before 30 August 2010. For a transfer of ownership, the MOP is counted from the effective date of the transfer or the date the owner was included as an authorised occupier. Owners can print confirmation of eligibility to rent out the whole flat through My HDBPage.

Tenants also have conditions. HDB states that they must not be tenants of public rental flats or owners of other HDB flats, subject to limited exceptions for divorced or legally separated persons and for owners who are eligible to rent out their own whole flat.

How many people can live in a rented HDB flat?

For a whole flat the cap is 4 occupants for a 1-room or 2-room flat and 6 for a 3-room or bigger flat, with a temporary relaxation to 8 for 4-room and bigger flats. These are MOM’s figures for foreign employees’ housing.

Flat type Max occupants (whole flat) Max bedrooms rented out
1-room or 2-room 4 Not allowed
3-room 6 1
4-room or bigger 6 (8 from 22 January 2024 to 31 December 2028) 2

Source: MOM, Various types of housing and their specific requirements, last updated 2 June 2026. HDB announced on 15 January 2026 that it would extend the temporary relaxation of the occupancy cap until 31 December 2028. MOM also states that a flat rented from HDB cannot be sublet.

What must an employer do when a worker rents an HDB flat?

The employer must make sure the worker lives in proper housing and that MOM has the correct address. MOM says employers who fail to do so can be prosecuted, banned from future Work Permit applications and renewals, and lose security bonds.

  1. Confirm the flat can be rented to your worker, including the Non-Citizen Quota check and the worker’s pass type and sector.
  2. Ask the flat owner to register your employees as tenants with HDB before they move in. MOM says this must happen before you can register the address in OFWAS or the EP eService.
  3. Declare the residential address and mobile number in the Online Foreign Workers Address Service (OFWAS). For Work Permit holders, MOM states this must be done before Work Permit issuance, for both new and renewal applications.
  4. Update any change of address or mobile number in OFWAS within 5 days.
  5. Keep a written tenancy agreement and a copy of the HDB rental approval letter. MOM highly recommends both, and also recommends regular checks on the state of the flat.

Is a private home easier for non-citizen tenants?

Often yes, because private residential property has no Non-Citizen Quota. MOM says all foreign employees may be housed in private residential premises, but a cap of 6 unrelated persons per property applies.

MOM states that owners renting out a private property for the first time must make a one-time declaration through the Foreign Worker Tenant Enquiry Service (FWTES). A temporary relaxation raises the cap from 6 to 8 occupants for private residential premises of 90 square metres or bigger until 31 December 2028, subject to URA approval. What if you plan to buy an HDB flat instead?

Renting and buying follow different rules. Everything above concerns renting a flat from an HDB owner, and says nothing about buying one. Check HDB’s resale eligibility rules separately before assuming a tenancy can lead to ownership. If you are a PR applicant, see buying an HDB resale flat while your PR application is pending.
