The risk for employers is straightforward. The Workplace Fairness Act 2026 codifies anti-discrimination duties around employment decisions, the PDPA frames consent and purpose limits on candidate data, and the Tripartite Guidelines on Fair Employment Practices set the cultural baseline. Tools deployed without those constraints in mind will not just fail an audit — they will fail to defend an EP application’s COMPASS narrative if it is ever challenged.

This guide sets out the legal frame, the practical playbook for employers, and what candidates need to know about how their applications are now read by an algorithm before a human ever sees them.

The Legal Frame: WFA, PDPA and Tripartite Guidelines

Three instruments do most of the work here.

Workplace Fairness Act 2026. The Act codifies the prohibition of discrimination in employment decisions on the grounds of protected characteristics — broadly including age, race, nationality, religion, gender, marital status, family responsibilities and disability. An algorithmic decision that adversely affects a candidate on a protected ground is the employer’s decision under the Act.

Personal Data Protection Act (PDPA). The PDPA imposes consent, purpose-limitation, accuracy and protection obligations on the handling of candidate personal data. AI hiring tools touch all four: candidates must be informed and consent to automated processing; data must only be used for the disclosed evaluation purpose; the underlying model must produce accurate outputs and not encode bias against protected groups; and the data must be protected, especially where it is processed by overseas vendors. Tripartite Guidelines on Fair Employment Practices (TGFEP). The cultural baseline.   • CV / resume parsing and matching. Natural-language models extract structured data from CVs — qualifications, prior roles, skills — and rank candidates against a job specification. This is the most mature segment. Risks centre on the model picking up proxies for protected attributes (a particular school, a particular country of origin, gendered names).
  • Asynchronous video interviews. Candidates record answers to standardised questions; the platform scores responses on linguistic content, sentiment, and (in a few legacy products) facial micro-expression. The latter category has been substantially deprecated globally because of bias and reliability issues; Singapore employers should not deploy facial-expression scoring.
  • Gamified assessments. Cognitive games and behavioural simulations measure traits — risk preference, attention, working memory, conscientiousness — that map to the role. Done well, these reduce reliance on credential proxies. Done badly, they introduce noise without insight.
  • Automated reference and background checks. Tools that surface social, public records and prior-employer signals. PDPA exposure is highest here, and the candidate-consent and purpose-limitation discipline must be airtight.

The right framing is not “AI versus human.” It is “machine-assisted shortlist with a human decision.” MOM has been consistent in expecting that the final hiring decision rests with a human reviewer — and that the human reviewer is genuinely making the call, not rubber-stamping the algorithm.

Vendor Due Diligence: A Singapore-Specific Checklist

Before deploying any AI screening tool in 2026, run a structured due-diligence pass. The questions that matter under the WFA / PDPA frame:

  1. Training data. What population was the model trained on, and is that population representative of Singapore’s candidate pool? A model trained on US graduate hires will not handle a Singapore polytechnic graduate’s CV the same way.
  2. Bias testing. Has the vendor performed disparate-impact testing across age, gender, ethnicity, and nationality? Ask for the disparate-impact ratios. A 4/5ths rule violation is a warning sign even if not legally dispositive in Singapore.
  3. Explainability. Can the platform produce a candidate-level explanation of why a candidate was ranked or scored where they were? An opaque score is hard to defend in a complaint.
  4. Human override. Does the workflow require a human reviewer to approve any rejection? It should.
  5. Data residency. Where is candidate data processed and stored? The PDPA does not prohibit overseas processing but requires comparable protection. Where the vendor stores data outside Singapore, the data-processing agreement must spell out the standards.
  6. Retention and deletion. How long is candidate data retained? It should be the minimum necessary. Indefinite retention of unsuccessful candidate data is a PDPA red flag.
  7. Notice templates. Has the vendor supplied candidate-facing notice language that complies with PDPA disclosure obligations? If not, draft your own.

  • Standardised, role-relevant tasks beat generic personality questionnaires.
  • Take-home or live coding evaluations should be calibrated for time fairness — candidates with caring responsibilities or accessibility needs should not be disadvantaged by tight timing alone.
  • Where pair-programming or simulated-meeting assessments are used, the rubric should be written down before the session, not after.

What Candidates Should Know

You can ask for human review. Where an automated system has rejected your application, you can request human review. The PDPA right of access to one’s personal data extends to information about how a decision was made. Standardised questions reward standardised preparation. Asynchronous video interviews use the same prompts for every candidate. That fairness cuts both ways — preparation is rewarded. Practice answering common competency prompts to camera. Maintain consistent eye contact with the camera lens. Keep answers structured (situation, task, action, result), at the upper end of the time window without hitting the cap.

Gamified assessments are not games. They look like games and they have score screens, but they are scoring you on cognitive load, response patterns and decision-making under pressure. Treat them as the work assessment they are — well rested, with no distractions, in a single sitting.

Documenting the Hire: The COMPASS-Defensible Trail

Where an EP application later attracts MOM scrutiny, the firm needs to be able to evidence that the hire was made on merit. AI screening, used well, actually strengthens that documentation:

  • The rubric and the assessment artefacts (CV scoring report, interview transcript, assessment results) form a contemporaneous record of why the candidate was preferred.
  • The diversity and bias testing reports from the vendor support the firm’s C4 narrative.
  • The human reviewer’s sign-off makes the decision defensible as a human one.

  • Candidate notice. A short statement disclosing that automated tools are used, what data they process, and how candidates can request human review. Embed in the careers page and the application acknowledgement email.
  • Vendor contract addendum. Data residency, retention, breach notification, audit rights, and an indemnity for known systemic bias. The addendum should sit on top of every AI-tooling contract.
  • Internal review checklist. A two-page checklist used by the human reviewer before approving any rejection: rubric reviewed, score consistent with rubric, no protected-attribute proxy in the rejection rationale.
